This Privacy Policy has been supplemented to comply with the California Consumer Privacy Act of 2018 (“CCPA”). Certain information contained in this Privacy Policy applies solely to visitors, users, and others who reside in the State of California. Unless otherwise defined herein, any terms defined in the CCPA have the same meaning when used in this notice.

BurstLoan collects several types of information that may identify a particular individual (“personally identifiable information”). BurstLoan collects personally identifiable information when you provide it to us through your use of this Website, such as completing one or more steps of a request form to request a loan from a lender participating in our lender network. BurstLoan utilizes the use of cookies to assign a unique identifier to your computer. Cookies may be used to help save information on past user activities and other preferences, so that you are not required to re-enter information each time you visit this Website, and to deliver content specific to your interests. The types of personally identifiable information that we collect, either directly or through the use of 'cookies' include: IP addresses, Internet Service Provider (ISP), date/time stamps, number of clicks, user information regarding which pages and links our visitors access, browser types, and language.
Non-Personally Identifiable Information
Personally identifiable information does not include:
- Publicly available information from government records.
- De-identified or aggregated consumer information.
- Information excluded from the CCPA's scope, such as:
- health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and the California Confidentiality of Medical Information Act (“CMIA”) or clinical trial data;
- personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (“FCRA”), the Gramm-Leach-Bliley Act (“GLBA”) or California Financial Information Privacy Act (“FIPA”), and the Driver's Privacy Protection Act of 1994.
Use of Your Information
BurstLoan uses the information you provide to us through this Website to deliver the products and services you request on this Website, to provide you with user support, to verify or review your information to determine whether it meets eligibility requirements for participating lenders, to connect you with participating lenders in our lender network or other third party lenders with whom we have a business relationship, to communicate with you by email, postal mail, telephone, and/or mobile devices about products or services that may be of interest to you from us, to display advertising tailored to your interests or background, to perform data and statistical analysis on use of the Website, to enforce our Terms Of Use, and to perform any functions otherwise described to you at the time we collect the personally identifiable information. BurstLoan may share personally identifiable information obtained from cookies for the purpose of aggregate web site statistical and trend analysis.
BurstLoan may also use the information you provide to verify your identity and protect against possible fraudulent transactions pursuant to Section 326 of the USA PATRIOT ACT in order to help the government fight identity theft, the funding of terrorism and money laundering activities, and to help verify a user's identity. BurstLoan may also use the information you provide to investigate complaints regarding your use of the Website, to receive payment from third party lenders in the event of a dispute, and for internal security purposes such as fraud detection and internal reporting. Lenders who receive the information you provide may obtain, verify, and record that information in order to identify the user.
Disclosing Personally-Identifiable Information
BurstLoan will share your personally identifiable information (including, without limitation, your financial account information and Social Security Number) with third parties for a business purpose including, without limitation, transferring or licensing, subject to your right to opt-out of such use by us of your personally identifiable information described herein. We may share your personally identifiable information with the following categories of third parties:
- Lenders participating in our lender network.
- Third party lenders with whom we have a business relationship.
These third party lenders may use your personally identifiable information to offer you a personal loan. Any lenders with whom we share personally identifiable information may have their own policies which describe how they use and disclose your information. Those policies will govern the use, handling, and disclosure of your information once we have transferred or shared it with those lenders as described in this Privacy Policy or our Terms of Use.
BurstLoan may also share your personally identifiable information with third party marketing companies who may use your personally identifiable information to communicate with you about other businesses, promotional offers, products, goods or services. Any licensees with whom we share personally identifiable information may have their own policies which describe how they use and disclose your information. Those policies will govern the use, handling, and disclosure of your information once we have shared it with those marketing companies as described in this Privacy Policy or our Terms of Use.
BurstLoan will disclose your personally identifiable information in response to a subpoena or similar investigative demand, a court order, or a request for cooperation from a law enforcement agency or other government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. You have the right to request that BurstLoan discloses certain information to you about our collection and use of your personal information over the past twelve (12) months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

Deletion Request Rights
You have the right to request that the we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:
- Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you

Your Choices About The Use of Your Information and Opting Out
California - Do Not Sell My Information
If you are a resident of California, you have the right to opt-out of having your information sold. You can make a request to opt out by using the following button below titled "Do Not Sell My Personal Information" and filling out the form that follows. If you do decide to opt-out, we will no longer be able to help you by connecting you to loan providers. Please be aware that if you resubmit your information on this site, you are acknowledging that you wish us to help connect you with a lender again and by doing so, we may sell your information.
Do Not Sell My Personal InformationExercising Access, Data Portability, and Deletion Rights
To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by sending us a message to us at support@burstloan.com or privacy@burstloan.com or by calling us toll-free at 1-844-720-6149. Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. By submitting a request to this Website, you certify that you are at least eighteen (18) years old and agree to both the Terms of Use and Privacy Policies that govern this Website. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
- Provide proof of California residency.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personally identifiable information if we cannot verify your identity or authority to make the request and confirm the personally identifiable information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personally identifiable information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.
Response Timing and Format
We will endeavor process your request, where possible and subject to the terms and conditions contained in this Privacy Policy, within forty-five (45) days upon receipt. If we require more time, we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personally identifiable information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, specifically by electronic mail communication. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will explain that determination and provide you with a cost estimate before completing your request.
Federal and State regulations and/or the need to administer our relationships with our lenders and other third party partners may require that we store certain information for various periods of time. In order to comply with these requirements, your information may be stored until the expiration of the applicable period. We will use commercially reasonable efforts to delete your personal information no later than ninety (90) days after receiving your request, unless a longer retention period is required by law. Any request to remove personally identifiable information will be applicable to information held by BurstLoan, and not information already shared with third parties. The treatment of such information is governed by those parties' privacy policies, not by this Privacy Policy.
Personal Information Transfer and Licensing Opt-Out and Opt-In and Email Unsubscribe Rights
BurstLoan is not intended for use by anyone under 18 years of age. The foregoing provisions nonetheless apply in the event we unintentionally obtain information from someone under 18 years of age.
If you are sixteen (16) years of age or older, you have the right to direct us to not transfer or license your personally identifiable information at any time (the "right to opt-out"). We do not transfer or license the personally identifiable information of consumers we actually know are less than sixteen (16) years of age, unless we receive affirmative authorization (the "right to opt-in") from either the consumer who is between thirteen (13) and sixteen (16) years of age, or the parent or guardian of a consumer less than thirteen (13) years of age. Consumers who opt-in to personal information sales may opt-out of future sales at any time.
To exercise the right to opt-out, you (or your authorized representative) may submit a request to us by emailing privacy@burstloan.com and by using the subject line “right to opt-out.”
Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personally identifiable information sales. However, you may change your mind and opt back in to personally identifiable information transfers or licensing at any time by emailing privacy@burstloan.com.
You do not need to create an account with us to exercise your opt-out rights. We will only use personally identifiable information provided in an opt-out request to review and comply with the request.
When you submit your information on BurstLoan, you may receive email messaging or third party marketing messages. You will be given the opportunity, in any commercial email that we send to you, to opt out of receiving such messages in the future. You may also opt out of receiving commercial emails by using the 'Unsubscribe' link on our site. Please allow for up to ten (10) business days for your request to be processed. If you remove your information from our database it will no longer be used for secondary purposes, disclosed to third-parties, or used by us or third-parties to send promotional correspondence to you. If your information has already been shared with a third party, it may be necessary to contact the third party directly to opt out of receiving information from them.
Non-Discrimination
We will not discriminate against you for exercising any of your rights under the CCPA. Unless permitted by the CCPA, we will not:
- Deny you goods or services.
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
- Provide you with a different level or quality of services.
- Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personally identifiable information ’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time. Further, you can choose not to provide us with certain personally identifiable information, however doing so may result in limited access to certain features and services provided on this Website and affect your ability to obtain a loan.
California Privacy Rights
California Civil Code Section 1798.83, also known as the 'Shine The Light' law, permits users who are residents of California to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Wireless Privacy Rights
We may use personal information you've provided on this site to administer the services you've requested, including wireless services that display customized content and advertising. In addition to any fee of which you are notified of, your wireless provider's standard message rates are applicable to our confirmation and all subsequent SMS correspondence. You may opt out from further SMS messages and remove your SMS information from our database by responding 'STOP', 'END' or 'QUIT' to the SMS text message you received. If you remove your SMS information from our database it will no longer be used by us for secondary purposes, disclosed to third-parties, or used by us or third-parties to send promotional correspondence to you.
Children Under The Age of 16
Our Website is not intended for children under 16 years of age. No one under the age of 16 may provide any personal information on our Website. We do not knowingly collect personal information from children under sixteen (16). If you are under sixteen (16), do not use or provide any information on this Website. If we learn we have collected or received personally identifiable information from a child under sixteen (16) without verification of parental consent, we will delete that information.
